A consumer who has purchased or leased a car or other kind of consumer vehicle possesses a number of protections under both state as well as federal laws in case the car does not operate as it should while under the manufacturer’s warranty. To qualify under the State Lemon Law and the federal Lemon Law, the consumer vehicle or other consumer good should have been subject to repeated repairs or been out of service for a considerable amount of days during the manufacturer’s factory warranty. Lemon Law compensation ranges from a refund, replacement or money compensation.

California’s Song-Beverly Consumer Warranty Act, commonly referred to as the CA Lemon Law, was passed in order to present relief to consumers who bought or leased troublesome vehicles and other consumer goods. Typically, the California Lemon Law pertains to automobiles which the authorized servicing dealerships have been unable to repair within the warranty period after being provided a reasonable amount of repair attempts. If the vehicle or other consumer good is deemed a lemon then the manufacturer must provide the consumer with his or her money back, pay the balance of the outstanding loan or substitute the consumer good with one that is substantially equivalent.

The California Lemon Law also mandates that the manufacturer provide for the consumer’s attorney’s fees and costs, if the consumer is deemed the prevailing party.  This makes the law financially feasible for those who would otherwise not be capable to retain a law firm.
