What undergraduate school did you attend and what did you study? I attended Arizona State University where I studied Political Science.

Can you share a notable case or success you’ve had in the past? Krause v. Mercedes-Benz, USA, LLC.: Plaintiffs filed a lemon law claim against MBUSA alleging that the parking brake was defective. Despite the Krause’s four presentations for verified problems with the brake assembly, MBUSA forced the case to trial alleging user error. MBUSA’s expert witness, Eric Wierman’s sole opinion was that the Krauses were somehow the cause of the very problem they complained about.  Mr. Weirman admittedly had no evidence to support his opinion. As lead counsel at trial, Brian sought to exclude Mr. Weirman’s opinions under Evidence Code 803, and the Court did so. MBUSA appealed arguing the trial court erred in excluding Mr. Weirman’s expert opinion, but the appellate court affirmed the decision.

What sets you apart from other lawyers in your field? What sets me apart is that I have tried cases for both consumers and manufacturers in lemon law matters.  I understand how manufacturers think and evaluate cases and costs associated with litigation.  This gives my clients the distinct advantage of having an advocate who has experience on both sides of the lemon law arena.

Brian earned his law degree from Loyola University Chicago School of Law and was admitted to practice in 2015.
