Our client was excited to purchase a new 2023 BMW X7 from a dealership in California. Shortly after taking ownership, the vehicle began experiencing persistent engine and transmission issues that led to several repair attempts at the dealership.

The first problem arose in the summer of 2023 when the vehicle had only 4,350 miles on it. The owner noticed a strange rattling noise from the engine, along with a rough idle.

After a diagnostic inspection, the dealership found no immediate issues and advised the owner to continue monitoring the situation. Despite this, the problem did not resolve and persisted.

By the end of summer, with 8,400 miles on the odometer, the engine rattling had worsened significantly, and the transmission was slipping. The dealership identified issues with both the engine mounts and the transmission fluid.

The engine mounts were replaced, and the transmission fluid was adjusted, but the symptoms persisted, leaving the owner frustrated. As the issues continued, the client returned to the dealership some months later with the vehicle exhibiting engine noise and stalling during acceleration.

The dealership replaced a faulty transmission solenoid and reprogrammed the transmission control module, but the transmission’s erratic shifting continued.

The final attempt at repair took place towards the end of our client’s first year of ownership, when the vehicle had accumulated only 12,500 miles. The owner reported poor engine performance and stalling.

The dealership confirmed a defective fuel injector and replaced it, but the issues were still unresolved. After spending more than 15 days at the dealership over multiple repair visits, the owner reached out to the Lemon Law Experts for assistance.

According to California’s Lemon Law, if a vehicle has unresolved mechanical issues after several repair attempts, the vehicle may qualify for a buyback.

With our assistance, a buyback agreement was successfully reached with BMW, resulting in a full refund for the defective vehicle, as well as coverage for the client’s legal fees.

If you’re experiencing similar ongoing vehicle issues, we encourage you to contact the Lemon Law Experts for a free consultation and to explore your legal options today.
