This client purchased a new 2021 Nissan Altima from Carson Nissan with just 17 miles on the odometer and a full manufacturer’s warranty.
However, over the next couple of years, the vehicle encountered several recurring issues, prompting multiple service visits to Carson Nissan and other dealerships for repairs.
These problems were primarily related to the air conditioning system, battery, axle, and persistent noises, all of which the customer sought to resolve under the warranty.
One of the first issues arose in 2022 when the air conditioning system began blowing only hot air. The service technician found that the AC system was empty of freon, and further inspection revealed low compression in the compressor.
As a result, parts including the high-side pipe and compressor were replaced. Despite these repairs, the issue persisted, and just months later, the customer returned with the same complaint.
The AC system was found to have a refrigerant leak in the evaporator, requiring additional repairs. However, even after these efforts, the system continued to struggle with recharging and cooling.
After this series of issues, the customer reported a ticking noise coming from the front of the vehicle when driving over uneven roads. An inspection determined that the noise was caused by foam around the dashboard coming apart and rubbing against the firewall.
The technician replaced the foam and secured the dashboard, resolving the issue. However, later that year, the customer returned with a new clicking noise coming from the vehicle when turning or reversing.
This time, the noise was traced to the right front axle assembly, which was replaced, and the vehicle was realigned. The noise was eliminated, but soon after, the customer experienced a similar issue, this time from the left front axle.
The left front axle was replaced, and the necessary components were realigned, successfully resolving the issue.
In addition to these mechanical problems, the vehicle experienced battery failure. The customer reported a long crank when attempting to start the car, and upon testing, the battery was found to be faulty.
It was replaced, and the charging system was verified to be functioning normally. The warranty covered the cost of the new battery, and the customer was informed of the prorated terms for future battery replacements.
Despite extensive repair efforts, the vehicle’s continued issues indicate the presence of recurring defects.
While the warranty covered most repair costs, the customer’s ongoing concerns regarding the repeated problems suggest that further legal action may be necessary under consumer protection laws, particularly the Lemon Law.
Although the repairs performed at Carson Nissan were essential for addressing the various defects, the persistence of issues qualified the vehicle for a Lemon Law claim.
