On January 2, 2020, our client purchased a brand-new 2020 Ford Super Duty F-250 from South Bay Ford in Hawthorne, California. Despite being a new vehicle, the Ford F-250 quickly manifested several issues that necessitated numerous warranty repairs.
The problems started shortly after the purchase and included malfunctions with the driver door, radio screen, rear axle, and various electrical systems.
Between June 7 and August 29, 2023, the vehicle spent 94 days in the service center. During this extensive service period, technicians replaced the front door trim panel and latch assembly and repaired the rear axle ring gear and pinion set. However, despite these efforts, the vehicle continued to exhibit problems.
For instance, on September 29, 2023, the client reported a clunk noise from the rear end, a blue screen on the display, and a rattling side view mirror. Although some issues, such as the pinion seal replacement, were resolved, other problems, like the screen turning blue, persisted.
Additional issues surfaced on October 10, 2023. The client reported a rattling noise from the driver’s door glass and a loud noise upon acceleration from a cold start. The service team confirmed these concerns and attempted various repairs, including lubricating the driveshaft and diagnosing a faulty Accessory Protocol Interface Module (APIM).
Despite these efforts, the problems continued to reoccur, greatly frustrating our client.
California’s Lemon Law provides protection for consumers whose vehicles are out of service for an extended period due to warranty repairs. Specifically, if a vehicle is out of service for 30 or more 30 days, it may qualify as a lemon.
In many cases, this alone can qualify a vehicle as a lemon, which legally entitles the owner to a refund or replacement. Given the ongoing issues and lengthy repair times, this client decided to seek legal assistance from the Lemon Law Experts.
At the Lemon Law Experts, we specialize in handling lemon law cases in California and have achieved substantial settlements for our clients since 2009.
