In a recent case against Honda, the plaintiffs successfully pursued legal action regarding ongoing issues with their newly purchased 2023 Acura MDX. The vehicle was acquired with only 98 miles on the odometer and was purchased from a dealer, subsequently serviced at an Acura dealership in Los Gatos, California.
Shortly after the purchase, the plaintiffs began experiencing persistent problems with the adaptive cruise control system.
At only 5,090 miles, they reported an error related to the adaptive cruise control on the dashboard. The servicing dealer inspected the vehicle and found no warning messages at that time. However, a diagnostic trouble code (DTC) U12B7-00 was noted, indicating a potential malfunction in the millimeter wave radar unit.
The dealer cleared the code and advised the plaintiffs to monitor the situation.
Despite initial repair efforts, issues persisted, prompting the plaintiffs to return to the dealer with continued reports of errors related to the adaptive cruise control, as well as vehicle sway while driving on Highway 85. The dealer diagnosed the same DTC and traced the problem to a faulty millimeter wave radar unit.
After replacing the unit and re-aiming it, the dealer conducted a test drive during which no errors were reported.
Unfortunately, the plaintiffs continued to face challenges with the adaptive cruise control system. At 1,065 miles, they reported that the error had returned, but multiple test drives by the dealer could not replicate the issue.
Just 1,000 miles later, they reported recurrent errors, not only with the adaptive cruise control but also related to the brake system. During this visit, they provided video evidence of the malfunctions, prompting the technician to consult a tech line for further guidance.
Given the ongoing nature of these issues, the plaintiffs were able to pursue legal action under the Lemon Law, which stipulates that a vehicle is considered a lemon if it has been in the repair shop repeatedly for the same issues.
This law aims to protect consumers by ensuring they are not left with defective vehicles that fail to perform as promised. As a result of the legal proceedings, Honda agreed to a buyback of the 2023 Acura MDX, providing reimbursement for the full purchase price, including taxes, fees, and associated costs incurred by the plaintiffs.
