Our client was excited to purchase a 2023 Volkswagen Golf R- the car was brand new, with only 12 miles on the odometer at the time of purchase. Unfortunately, our client did not have much time to enjoy the vehicle in proper working condition as the vehicle began experiencing serious issues shortly after purchase.

The first major issue occurred in late 2023, when the check engine light illuminated at around 4,642 miles. Our client reported that the car exhibited a rough idle, and in some instances, the engine would start but then shut off. In response, their local Volkswagen dealership conducted a multi-point inspection and performed a road test, adjusting the tire pressures to the manufacturer’s specifications.

Despite these efforts, the rough idle could not be replicated, and no misfires were detected during the test. The technician suggested that our client return if the problem persisted.

At 5,457 miles, the issue still had not been resolved. Our client brought the vehicle in for repair work again, this time for a check engine light that remained on. A diagnostic revealed multiple fault codes, including a low-pressure fuel problem. The technician pinpointed the issue to the high-pressure fuel pump, which was subsequently replaced.

Despite these efforts, the vehicle continued to exhibit issues with stalling, particularly during idle and while warming up. Even after replacing the fuel control module, the problem persisted, and the car continued to stall during key cycles, with no permanent solution in sight.

Finally, in 2024, the vehicle was towed to Cardinale Automotive Group due to the ongoing no-start issue. Volkswagen Corporation was contacted for further inspection, and the dealership was instructed to perform additional work. Despite multiple repairs, including part replacements, the car remained unreliable, and the issues continued to go unresolved.

Given the recurring and unresolved issues with the vehicle, including the failure to repair persistent fuel pressure problems and stalling, our client was within his right to pursue a lemon law claim under California’s Song-Beverly Consumer Warranty Act.
