A consumer who purchases or leases a car or truck or other vehicle with a warranty has a number of legal rights under both state and federal regulations in case the vehicle fails to operate as presented while under an express manufacturer’s warranty. Warranty regulations are often complicated. The information below provides a brief and quick glance at the Magnuson-Moss Warrant Acty and the Song-Beverly Consumer Warranty Act, what is generally referred to as “Lemon Law.”

California Lemon Laws as well as federal Lemon Law (the Magnuson-Moss Warranty Act) provide relief for CA purchasers or lessees of defective cars as well as vans, other motor vehicles and consumer products such as motor bikes, RV’s, boats, computer systems and various individual appliances and goods. To meet the requirements under the California Lemon Law or the federal Lemon Law, generally, the consumer good needs to have been subject to multiple repairs within the manufacturer’s warranty period. Lemon Law damages can include reimbursement, replacement good or cash payment.

California’s Song-Beverly Consumer Warranty Act, known as the CA Lemon Law, was put into law in order to give relief to consumer who have purchased or leased problematic vehicles and other consumer goods. Generally, the California Lemon Law applies to cars, trucks and other vehicles that the authorized servicing dealerships are not able to repair within the warranty period after being provided a reasonable amount of opportunities. For qualifying claims, the manufacturer of the consumer good  needs to provide the consumer with his or her money back and even pay off the remaining loan amount or exchange the consumer good with one that is substantially comparable.

If the consumer is the prevailing party, the California Lemon Law requires the manufacturer to pay for the consumer’s  attorney’s fees and costs.  This makes the lemon laws financially feasible for those who would otherwise not be able to retain a lawyer.
