Lemon Law Steps

If you think your vehicle may be a lemon because the manufacturer could not repair the defects after multiple repairs attempts for the same malfunction or if the vehicle is rendered un-fixable, seriously impaired or unsafe to operate, then you may be entitled to a replacement vehicle, refund, or cash compensation. The Lemon Laws may also apply if the vehicle is out of service, at a dealership for example for repairs, for a cumulative total of 30 days. As part of the Lemon Law, the consumer is responsible for the miles driven until the first repair attempt when the original Lemon Law claim was made.

If you get a vehicle refund, this will include all of your monthly payments, including finance charges and sales tax, the pro-rated amount of the registration fees paid and reimbursement of related consequential and incidental expenses such as rental car and/or tow truck expenses.

If you get a vehicle replacement, the manufacturer will provide you with a vehicle that is substantially similar to the one that is a lemon.  The remaining time of your finance or lease term will transfer over to the replacement vehicle.  You will be liable, however, for any difference in price between the vehicle that is a lemon and the replacement vehicle.

If your vehicle is not deemed a lemon, you may receive cash compensation for the diminished value of your vehicle.  This is the difference in price for the vehicle that you paid for and the one that you received with all of the problems.
