What is Lemon Law?

Lemon laws are designed to protect consumers who purchase or lease motor vehicles that do not meet their quality standards. In California, the Song-Beverly Consumer Warranty Act (the Lemon Law) provides consumers with valuable legal rights and remedies for vehicles that are defective or non-conforming.

Under the Lemon Law, a consumer can be entitled to a full refund of the purchase price (or lease payments made) plus reasonable incidental damages for defective motor vehicles. Incidental damages include rental car fees, repair costs, and other expenses associated with the vehicle’s defect or non-conformity.

More provisions of the Lemon Law include:

  • Requiring manufacturers to repurchase or replace defective vehicles or components that are still under warranty
  • Allowing consumers to recover reasonable attorney fees and costs associated with a Lemon Law claim
  • Requiring manufacturers to pay punitive damages for certain willful violations
  • Providing consumers with additional legal remedies when a manufacturer fails to comply with warranty obligations
  • Prohibiting manufacturers from disclaiming certain warranty rights

Note that there are some limitations to the Lemon Law. For example, the defect must qualify as a “nonconformity” under the terms of the warranty and there is usually a time limit for filing a Lemon Law claim.

Is Your Vehicle a Lemon?

As mentioned previously, a “lemon” vehicle is one that does not meet the quality standards of the manufacturer. To determine if your car is a lemon, you should consider the following indicators:

  • The vehicle has been in for repairs multiple times for the same issue
  • The manufacturer has had the vehicle for 30 or more days to repair a defect
  • The manufacturer fails to properly address the issue despite multiple attempts
  • The defect substantially impairs the use, value, or safety of the vehicle
  • Other potential signs of a lemon vehicle include:
  • Poorly fitting body panels or doors
  • Excessive vibration from the engine that cannot be fixed
  • Strange noises that cannot be traced to a specific source
  • Electrical or computer system problems that cannot be diagnosed or fixed
  • Brake problems that have been ongoing for months
  • Fluid leaks
  • Unusual tire wear or imbalance in the steering system
  • Hesitation or stuttering during acceleration
  • Uneven tire wear, even after rotating the tires every 5,000 miles
  • An engine that overheats regularly
  • A transmission that slips, hesitates or fails to shift properly
  • Poor fuel economy
  • Poorly installed accessories or parts
  • A defective interior, such as seats that do not adjust properly

If you have experienced any of the above issues with your vehicle and believe it may qualify as a lemon, you should contact a Modesto Lemon vehicle attorney as soon as possible. Our team will evaluate your case and determine if you are entitled to compensation under the Lemon Law. We can also provide valuable advice and guidance during the Lemon Law arbitration process.

Time Limits and Requirements for Filing a Lemon Law Claim in Fremont

In California, consumers typically have up to four years to file a Lemon Law claim. This applies to both new and used vehicles.

In order to file a successful claim, consumers must be able to demonstrate that they have made reasonable attempts to fix the defect by taking the vehicle to an authorized repair facility. The reasonableness of these attempts is usually determined based on the severity of the defect and the number of attempts made.

Beyond Lemon Law: Other Options for Recourse

In some cases, the Lemon Law may not apply. In these situations, consumers may have other options for recourse.

For example, consumers may be able to pursue a breach of a warranty claim or an action under the Magnuson-Moss Warranty Act.

Additionally, consumers may be able to pursue a case against the dealer or manufacturer for other types of damages, such as fraud, breach of contract, or violations of consumer protection laws.
