Houston, California Lemon Law Attorneys

Consumers in Palmdale rely on their vehicles every day. When a manufacturer sells a vehicle with recurring defects that substantially impair its use, value, or safety, the California Lemon Law provides important protections for consumers.

Under the California Song-Beverly Consumer Warranty Act, commonly referred to as California’s Lemon Law, consumers may be entitled to remedies when a vehicle cannot be repaired within a reasonable number of warranty repair opportunities.

Potential remedies under the California Lemon Law may include:

  • Repurchase or replacement of the defective vehicle
  • Reimbursement of incidental and consequential expenses, including towing, rental car, and related costs
  • Civil penalties of up to two times the consumer’s actual damages in qualifying cases
  • Recovery of attorney’s fees and costs

These remedies may be available for qualifying new, used, certified pre-owned, and leased vehicles that experience warranty-related defects.

How Do I Know If My Vehicle May Qualify Under the California Lemon Law?

The California Lemon Law may apply to qualifying new, used, certified pre-owned, and leased vehicles that continue to experience warranty-related defects. In many cases, a vehicle may qualify when the manufacturer or authorized repair facility has been unable to repair a substantial defect within a reasonable number of repair opportunities.

Factors commonly considered in evaluating a potential lemon law claim include:

  • The vehicle has a defect covered by the manufacturer’s warranty that substantially impairs the vehicle’s use, value, or safety
  • The manufacturer or authorized dealership has been given a reasonable opportunity to repair the issue
  • The defect continues to exist despite repeat repair attempts
  • The vehicle has been out of service for a significant number of days for warranty-related repairs
  • The issues were not caused by unauthorized modifications, misuse, or neglect

Every case is different, and eligibility depends on the specific facts, repair history, and applicable law. If your vehicle continues to experience recurring problems, our firm can review your repair history and help determine whether you may have rights under the California Lemon Law.

Do I qualify for Lemon Law in Texas?

To qualify for the Lemon Law in Texas, your vehicle must meet several conditions:

  • Type of Vehicle:Ā The law covers new vehicles, including cars, trucks, vans, motorcycles, motor homes, and certain towable recreational vehicles.
  • Defect:Ā The vehicle must have a substantial manufacturing defect that is covered by the manufacturer’s written warranty.
  • Repair Attempts:Ā You must have given the auto manufacturer a reasonable number of warranty repair attempts to repair the defect. This is typically defined as:
    • Four-Times Test
      • Two repair attempts for the same problem or defect within the first 12,000 miles or 12 months, whichever comes first, and
      • Two more repairs during the 12,000 miles or 12 months after the second repair attempt, and
      • The problem is still not repaired
    • Serious Safety Hazard Test
      • One repair attempt during the first 12,000 miles or 12 months, whichever comes first, and
      • Once more repair attempt during the 12,000 miles or 12 months following the first repair attempt and
      • The problem is still not repaired
    • 30-Days Test
      • If the vehicle is out of service for 30 or more days during for warranty repairs during the first 24,000 miles or 24 months
  • Notification:Ā You must notify the manufacturer in writing about the defect and give them at least one opportunity to fix it.
  • Impact:Ā The defect must substantially impair the vehicle’s use, market value, or create a serious safety hazard.

If your vehicle meets these criteria, you may be eligible for a replacement, repurchase, or cash compensation under the Texas Lemon Law.

How long do you have to file a Lemon Law complaint in Texas?

In Texas, you must file a Lemon Law complaint within six months of the earliest of these events:

  1. Expiration of the express warranty term.
  2. 24 months after the date of purchase.
  3. 24,000 miles following the date of delivery of the vehicle.

This means you need to act promptly if you believe your vehicle qualifies under the Lemon Law.

What are the exceptions to the Lemon Law in Texas?

The Texas Lemon Law has several exceptions and limitations. Here are some key points:

  • Altered or Modified Vehicles:Ā If the vehicle has been altered or modified after leaving the manufacturer, it may not be covered.
  • Negligence or Abuse:Ā Defects or conditions resulting from owner negligence, abuse, or unauthorized modifications are not covered.
  • Minor Issues:Ā Defects that do not substantially impair the use, market value, or safety of the vehicle, such as minor rattles or radio static, are not covered.

If your vehicle falls into any of these categories, it may not be eligible for relief under the Texas Lemon Law. However, other legal options might still be available, such as the Magnuson-Moss Warranty Act or state-implied warranty laws

What are example settlements?

In Texas, lemon law settlements can vary based on the specifics of each case. Here are some common types of settlements:

  • Repurchase:Ā The manufacturer buys back the defective vehicle from the consumer. This typically includes the down payment, monthly payments minus a usage fee, which is the value for when the vehicle was first driven without the problems causing it to be a lemon.
  • Replacement:Ā The manufacturer provides a new vehicle of the same make and model to the consumer in exchange for the lemon vehicle.
  • Cash Settlement:Ā The manufacturer offers a cash settlement to the consumer, while the consumer retains possession of the vehicle.

Each settlement is unique and depends on the negotiations between the consumer and the manufacturer.
