VinFast is a Vietnamese automotive company that claims to have cutting-edge and innovative fast-charging battery systems for their electric vehicles.
However, a recent class action is alleging almost exactly the opposite, that VinFast lied to its consumers about the capability and speed of their EV chargers.
If these allegations are proven true, affected consumers may be left with vehicles that fall far short of the performance they were promised.
For those experiencing repeated charging issues or other persistent defects, lemon law protections may offer a path to compensation or relief.

Which VinFast Models Are Affected?
The class action lawsuit, filed in June 2025, alleges that consumers were misled as to the VinFast VF 8 Plus EV’s charging capabilities.
Only that model is impacted; VinFast sells around 7 other EV models, but the class action only mentions the VF 8 Plus.
What’s Causing the Slow Charging Speeds?
The exact cause of the slow charging speeds is unknown, but it seems to be caused by some kind of software problem in the vehicle that relates to charging amp rates.
While consumers were told that the vehicle could be charged at the ordinary-for-EVs 32-amp rate, they discovered that software defects made the vehicle only charge at much lower amp rates around 19 or lower.
This naturally increases the charging time of the vehicle, and according to the class action, this makes the vehicle basically unusable for normal, day-to-day operation, because the vehicle needs to charge for so long before it can be driven.
With this glitch in place, a consumer might wait many hours before their car is charged, which makes the vehicle unpractical for drives away from home.

Real VinFast Owner Experiences
VinFast owners not involved in the class action have posted complaints about these issues all across the Internet. Below are some standout examples further detailing the problems.
Complaint #1 (VinFast Community Forum)
“The most frustrating problem is with charging. The VF8 often stops charging automatically after only a 3–5% increase in battery level. I’ve had to reconnect the charger adapter 3–4 times overnight, almost every time I charge — leading to several sleepless nights. Despite a recent service visit to VinFast, the issue recurred the same day. I’ve tested the same JuiceBox charger with a Tesla, and it worked flawlessly. This strongly points to a compatibility or internal issue with the VF8, and it’s disappointing that there doesn’t seem to be a proper fix yet.”
Complaint #2 (VinFast Community Forum)
“Has anyone experienced charging issues? I was never able to charge using the issued level 1 charger. I just recently installed a level 2 charger. It worked 1 time, but now the on light turns yellow and it turns off. It’s very frustrating to say the least. I have an Autel MaxiCharge. I’m pretty sure they’re the same supplier for the VinFast level 2 charger.”
Complaint #3 (Facebook VinFast Owners Club US/CAN)
“Hi, just traded my 21 kona ev for a 23 vf 8. Never had an issue with my home charger on my kona or ioniq 5. However, my vf 8 flashes and says it’s charging but says it’s receiving 0Kw’s. I also tried the vinfast charger that was in the car it also says similar. I’ve played around with settings and left it on from 11am to 830pm and has not charged still says 65 hrs to charge. Any thoughts or ideas. Charging at home makes having an ev for me way easier so really hoping to find a solution any help appreciated.”
Has VinFast Issued a Recall or Technical Service Bulletin?
It does not appear that VinFast has yet issued a recall or technical service bulletin for the battery charging issues; there were some recalls for VinFast vehicles also impacted by the charging problem, but those recalls were primarily for airbag issues.
One recall issued for the VinFast VF 8, which is impacted by the charging issue, involved the panel that shows speed and other information going blank, likely due to an electrical glitch.
It’s possible this recall’s cause is connected to the battery charging issue, but no concrete information confirming that has been released by VinFast or other organization.
The National Highway Traffic Safety Administration’s Campaign Number for that recall is 23V355000.
Can You Join the Class Action or File a Lemon Law Claim?
As a consumer experiencing problems with your vehicle, you have two options if a class action lawsuit has already been started: joining that class action or filing your own individual lemon law claim.
Below is a breakdown of each route, since there are unique benefits and challenges that come with each option.
When to Join a Class Action Lawsuit
Joining a class action lawsuit can be a smart move for some consumers, but it’s not always the right choice for everyone.
On the one hand, class actions allow individuals to band together against large corporations, often making it possible to hold companies accountable when the cost of individual lawsuits would be too high.
They can be especially helpful when a widespread issue—like a defective product, misleading advertising, or unlawful business practice—has affected thousands of people in similar ways, as could be the case here with the VinFast VF 8.
By joining a class action, consumers may benefit from experienced legal representation without paying out-of-pocket legal fees, and they may receive a portion of any resulting settlement or judgment.
It’s a convenient option that requires minimal involvement from each participant.
When to Contact a Lemon Law Attorney
Filing an individual lemon law claim can be a powerful way for consumers to seek justice when stuck with a defective vehicle.
One of the biggest advantages is the potential for individualized compensation. If your vehicle qualifies as a lemon, you may be entitled to a full refund, a replacement vehicle, or a cash settlement—often much more than you’d receive from joining a class action.
Lemon law claims are also handled on an individual basis, which means your case is evaluated based on your specific situation, giving you more control and the opportunity for a tailored outcome.
Most lemon law attorneys work on a contingency basis, so you typically don’t pay out of pocket—the manufacturer pays your legal fees if you win.
However, because lemon law claims are handled individually, they do require more investment from the individual, both in terms of time and money.
With an experienced lemon law attorney by your side, the process is much less stressful and runs smoother than it otherwise would!
