The following provides some quick and brief information regarding the Magnuson-Moss Warranty Act and the Song-Beverly Consumer Warranty Act and what is generally referred to as “Lemon Laws.”
California Lemon Laws and the federal Lemon Law (the Magnuson-Moss Warranty Act) provide consumer with relief if they have purchased or leased defective passenger cars, trucks and other consumer motor vehicles and consumer products including motorbikes, RV’s, motorboats, computers along with individual home appliances and products. To qualify under the State Lemon Law and the federal Lemon Law, you must have a consumer good with a warranty that endured multiple repair attempts within the manufacturer’s factory warranty. Lemon Law settlements may include a refund, replacement good or cash compensation for the diminished value of the good.
California’s Song-Beverly Consumer Warranty Act, typically called the CA Lemon Law, was enacted in order to provide relief to purchasers and lessees of troublesome cars and other consumer vehicles and goods. Usually, the California Lemon Law is applicable to motor vehicles where the authorized service dealerships are not able to repair the vehicle during the warranty time period after being provided a reasonable number of opportunities to do so. If the consumer vehicle or other consumer good is deemed to be a ‘lemon’, the manufacturer needs to provide the buyer or lessee his / her money back plus pay the balance of the outstanding loan amount or exchange the consumer good with one that is substantially similar.
If the consumer is the prevailing party, the California Lemon Law requires the manufacturer to pay for the consumer’s attorney’s fees and costs. This makes the lemon laws financially feasible for those who would otherwise not be able to retain a lawyer.
